1. Acceptance of Terms
By accessing or using GymMeUp, you agree to be bound by these Terms & Conditions.
If you do not agree to these Terms, you must not use the platform.
These Terms apply to all users of the platform, including visitors, registered trainees,
registered trainers, and any person accessing shared materials through an authorized account.
2. Eligibility & Accounts
You must be at least 18 years old, or the legal age required in your jurisdiction, to create
an account and use GymMeUp independently. If local law allows minors to participate with
parental or guardian consent, such consent must be obtained before use.
You agree to provide accurate, current, and complete information during registration and to
keep your account information up to date.
You are responsible for all activity that occurs under your account.
3. Trainer and Trainee Roles
GymMeUp supports different user roles, including trainers and trainees. Platform features,
dashboards, visibility, messaging access, uploaded materials, and account tools may differ
depending on the role assigned to your account.
Trainees may select or be assigned to a trainer through the platform. Trainers may access
trainee information made available through the platform for coaching purposes, subject to
these Terms and the Privacy Policy.
Trainers are solely responsible for the coaching, advice, educational material, and other
content they provide to trainees through GymMeUp.
4. Acceptable Use
You agree not to:
- use the platform for unlawful, fraudulent, abusive, or misleading purposes;
- impersonate another person or misrepresent your identity, credentials, or role;
- upload viruses, malware, malicious code, or disruptive content;
- attempt to gain unauthorized access to accounts, data, infrastructure, or private media;
- copy, scrape, reverse engineer, or interfere with the platform or its security controls;
- share, redistribute, resell, or publicly leak private materials made available through GymMeUp without authorization;
- use the platform to harass, threaten, exploit, or harm another user.
5. User Content & Media
Users may upload or share content through GymMeUp, including profile information, messages,
images, videos, notes, meal plans, coaching materials, and related content (“User Content”).
You retain ownership of your User Content, but by uploading or sharing it through the platform,
you grant GymMeUp a limited, non-exclusive, revocable right to host, store, process, display,
transmit, and technically reproduce that content solely for the purpose of operating,
securing, improving, and providing the service.
You represent and warrant that you have the right to upload, share, and use any User Content
you submit, and that such content does not infringe the rights of any third party.
Certain shared media may be made available through protected or time-limited access links.
GymMeUp may use technical restrictions intended to reduce unauthorized redistribution, but no
digital delivery system can guarantee that content cannot be copied, recorded, captured, or redistributed.
6. Messaging & Communications
GymMeUp may provide private messaging or chat between authorized users, including between
trainers and trainees. You agree to use these tools only for lawful, relevant, and respectful communication.
Messages, trainer notes, attachments, and related communication data may be stored and processed
in order to provide the service, maintain security, resolve disputes, and improve platform functionality.
You must not use the messaging system to distribute spam, harmful files, illegal material,
abusive content, or content that violates the rights of another person.
7. AI Features & Calculators
GymMeUp may provide AI-assisted tools and automated calculators, including calorie estimates,
meal planning support, summaries, and similar informational features.
These tools are generated automatically and may be incomplete, inaccurate, generalized,
unsuitable for your individual circumstances, or based on assumptions inferred from your inputs.
AI-generated or calculated outputs are provided for general informational and educational purposes only.
They do not replace a qualified trainer, dietitian, physician, or other licensed professional.
8. No Medical Advice
GymMeUp is a fitness and coaching platform, not a medical service. Nothing on the platform,
including messages, meal plans, calculators, AI outputs, progress tools, media, or trainer content,
constitutes medical advice, diagnosis, treatment, or emergency care.
You should consult an appropriately qualified healthcare professional before starting or changing
any exercise, nutrition, supplementation, or wellness program, particularly if you have a medical condition,
injury, allergy, intolerance, pregnancy, or other health concern.
Your use of any workout, nutritional suggestion, or coaching recommendation is at your own risk.
9. Privacy & Data Use
Your use of GymMeUp is also governed by our Privacy Policy, which explains how we collect, use,
store, and protect personal data, including account data, fitness profile information, chat content,
media uploads, and analytics.
By using GymMeUp, you acknowledge that such data may be processed as described in the Privacy Policy.
10. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for restricting
access to your device and account.
You must notify GymMeUp promptly if you suspect unauthorized access, credential compromise,
or misuse of your account.
We reserve the right to require password resets, suspend access, or take technical measures where
reasonably necessary to protect users, content, or infrastructure.
11. Availability & Changes
We may modify, suspend, update, limit, or discontinue any part of GymMeUp at any time, including
features, pricing, account tools, AI functionality, media systems, or integrations.
We do not guarantee uninterrupted availability, error-free operation, or permanent retention of
any particular feature, content, or data.
12. Payments & Services
If GymMeUp offers paid services, subscriptions, trainer programs, premium tools, or other billable
features, additional pricing and billing terms may apply and will be presented at the point of purchase.
Unless expressly stated otherwise, trainer-provided services are the responsibility of the trainer,
and GymMeUp acts as the platform provider rather than the provider of individualized coaching outcomes.
13. Suspension & Termination
We may suspend, restrict, or terminate access to GymMeUp, with or without notice, if we reasonably
believe that you have violated these Terms, created risk for users or systems, or engaged in misuse,
unlawful behavior, or unauthorized distribution of content.
You may stop using the platform at any time. Account deletion requests, where available, may be
handled in accordance with applicable law and our Privacy Policy.
14. Disclaimer & Limitation of Liability
GymMeUp is provided on an “as is” and “as available” basis, to the maximum extent permitted by law.
We disclaim all warranties, whether express or implied, including fitness for a particular purpose,
merchantability, non-infringement, and uninterrupted availability.
To the fullest extent permitted by law, GymMeUp and its operators shall not be liable for any indirect,
incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profit,
revenue, goodwill, content, or opportunity arising from or related to your use of the platform.
Where liability cannot be excluded by law, it shall be limited to the minimum extent permitted,
and if applicable, to the amount paid by you to GymMeUp during the 12 months preceding the event giving rise to the claim.
15. Intellectual Property
Except for User Content owned by users, all platform materials, branding, interface design, software,
layouts, and related assets made available by GymMeUp are owned by or licensed to GymMeUp and are
protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, republish, sell, or exploit any part of the platform
except as expressly permitted in writing.
16. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of
Romania, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or the use of GymMeUp shall be subject to
the exclusive jurisdiction of the courts of CLUJ-NAPOCA / ROMANIA, unless applicable law requires otherwise.
